I9 Forms 2022 – Form I-9, officially the Employment Eligibility Verification, is a United States Citizenship and Immigration Services form. Mandated by the Immigration Reform and Control Act of 1986, it’s used to verify the legal identity and authorization to work of all employees paid in the United States. Every employer in America has to submit Form I-9 accurately to hire any employee to work in the United States.

Are Employers Legally Required To Reverify Or Update I-9 Documents?
I9 Forms 2022 – Employers must update employee documents when employee’s employment authorization (EAD) or receipt expires. Reverification must be done not later than the date of expiration for the work authorization. Employees could lose their job if their employer does not reverify the authorization. Employees who are on temporary work permits are encouraged to apply for an extension at least 90 days prior to the expiration date of their EAD. Certain employment eligibility categories who submit on time EAD renewal applications can be granted automatic extensions of their expiring EADs.
Employers may fill out Section 3 of the original Form I-9 provided that it’s the latest version of the form. If the original version is a prior version of Form I-9 then the employer must either fill in Section 3 on the current version of the I-9 or fill out a brand new I-9 entirely in the current version. In either situation, the employer must add the new Form I-9 to the original one.
If an employee has given a receipt for a document after completing the I-9 in the first place, he/she is given 90 days to provide the employer the replacement document. The employer must use Section 3 of the current Form I-9 to alter the information or draw an outline over the previous information to ensure it is legible. After the line has been drawn, insert the updated information and then sign and ink the change. If the employee presents another acceptable document within the deadline that the employer has to fill out Section 2 on the new Form I-9. Attach it to the original Form I-9.
I-9 forms that contain green cards that are no longer valid then , they should not be issued again. Green cards are a permanent residence permit which can be used in the United States. They expire similar to driver’s licenses. However, the date of expiration does not mean that the holders have lost their right to work in the United States.
Employers can also modify Section 3 of Form I-9 if an employee’s name changes. However, it’s not required to do it.
