What Is The Time Frame For Employers To Revise And Update I-9 Documents?
I9 PDF 2022 – Employers must update employee documents whenever an employees’ employment authorization (EAD) or receipt is due to expire. Reverification should occur before the expiration date of the work authorization. If the employer isn’t able to renew the authorization, then the worker’s contract may end. Temporary visa holders are advised to file for an extension no later than 90 days before the expiration date of their EAD. Certain employment eligibility categories who file promptly EAD renewal applications could be granted automatic extensions for their expiring EADs.
If the form originally used is in use, employers may fill out Section 3 of the I-9 originally issued. If the original Form I-9 is older, the employer has to complete Section 3 or complete a completely new I-9 using the latest version. In either of these scenarios the employer has to add the new Form I-9 to the original one.
A worker who provided an acknowledgment of an item when filling out the I-9 initial form will have 90 days to present his employer with the replacement document. Employers must utilize Section 3 of the current Form I-9 in order to change the information or draw an outline around the original information to ensure that it can be read. After the line has been drawn, add the new information , then confirm the change by inking it. If the employee is able to present another acceptable document within the time limit and the employer is required to complete Section 2 of the current Form I-9. Attach it to the original Form I-9.
I-9 forms that include green cards that have expired should not be reverified. Green cards are proof of permanent residence in the United States, and they expire just as driver’s licenses do. However, the expiration date does NOT mean that the owner has lost their authority to work in the United States.
Employers can also opt to update the Form I-9 in Section 3 when an employee’s name changes. changed names, however, there is no obligation to do this.
