Are Employers Legally Required To Reverify Or Update I-9 Documents?
I9form 2022 – Employers are required by law to reverify the documentation of employees only when the employee’s employment authorization form (EAD) or the receipt has expired. The reverification process must be completed no later than the expiration date of the authorization to work. The worker may be fired if the employer fails to reverify the authorization. Temporary work visa holders are advised to file for an extension not later than 90 days prior to the expiration of their EAD. Certain eligibility categories for employment may be entitled to automatic extensions of expired EADs if they file timely EAD renewal applications.
If the original form is current employers may complete the Section 3 of the I-9 originally issued. If the original is an earlier version of Form I-9 employers must either fill in Section 3 on the current version of the I-9 or fill out a new I-9 completely on the current version.
