What Is The Date By Which Employers Must Revise And Update I-9 Documents

IRS Form I-9 2022 – Employers are required by law to reverify an employee’s paperwork only when the employee’s employment authorization documentation (EAD) or the receipt is expired. Reverification should be done before the expiration date of the authorization to work. The worker may be fired if their employer fails to update the authorization. Temporary visa holders are advised to request an extension not later than 90 days before the expiration of their EAD. Certain categories of employment eligibility that file timely EAD renewal applications could receive automatic extensions to their expiring EADs.

If the original form is current, employers may fill out the Section 3 of the I-9 originally issued. If the original version is an earlier version of the Form I-9, the employer should either fill in Section 3 on the current version of the I-9 or fill out a new I-9 completely using the latest version. In either case the employer has to attach the new Form I-9 to the original one.

If an employee gave an acknowledgment of a document after completing the I-9 in the first place, he/she has 90 days to present the employer the updated document. Employers must utilize Section 3 of the current Form I-9 to modify the details or draw an outline around the original information to ensure that it can be read. Once the line has been drawn, the employer must insert the new information and mark the new information and then ink it. If the employee presents another acceptable document within the stipulated time then the employer should complete Section 2 of the current Form I-9. Attach it to the original Form I-9.

I-9 forms that mention green cards that have since expired, should not be renewed. Green cards signify permanent residence in the United States, and they expire the same way as driver’s licenses do. The date of expiration doesn’t mean that the holder is no longer able to work within the U.S.

Employers can also update Section 3 of Form I-9 when an employee’s name is changed. However, it’s not required to do it.
