IRS I9 2022 – Form I-9, also known as the Employment Eligibility Verification is a United States Citizenship and Immigration Services document. What Is The Deadline For Employers To Reverify Or Update I-9 Documents?
IRS I9 2022 – Employers are required by law to reverify the documentation of employees only when the employee’s employment authorization form (EAD) or the receipt has expired. The reverification process must be completed prior to the expiration date of the work authorization. If the employer is not able to update the work authorization, the worker’s job may end. Temporary workers with work visas are advised to request an extension at least 90 days before the expiration of their EAD. Certain employment eligibility categories could be entitled to automatic extensions to their expired EADs in the event that they file on time EAD renewal applications.
Employers may complete Section 3 of the original Form I-9 provided that the original is the latest version of the form. If the original Form I-9 is older, the employer must fill out Section 3 or complete a completely new I-9 with the current version. In either scenario the employer must attach the new Form I-9 to the old one.
If an employee issued an acknowledgment of a document when completing the initial form I-9 in the first place, he/she is given 90 days to provide the employer the replacement document. Employers must utilize Section 3 of the current Form I-9 to alter the information or draw an outline through the information that was previously provided to ensure it is legible. Once the line is drawn, the employer must insert the updated information and then make sure to sign and write the change. If, within the 90-day window, the employee is required to provide another acceptable document, which differs from the receipt document was issued, the employer should complete Section 2 on the new Form I-9 and attach it to the original Form I-9 and provide a note of explanation either in the additional information box located on the 2nd page of the Form I-9 or as a separate attachment.
I-9 forms that contain green cards which have expired shouldn’t be re-issued. Green cards guarantee permanent residency in the United States, and they expire the same way as driver’s licenses do. However, the date of expiration does NOT mean that the person who holds the card has lost their ability to work in the US.
Employers are also able to modify the Form I-9 in Section 3 whenever an employee is affected by changed their name, however there’s no requirement to do this.
