What Is The Date By Which Employers Must Revise And Correct I-9 Documents
List Of Acceptable I-9 Documents 2022 – Employers are required to reverify the employee’s documentation when employee’s employment authorization (EAD) or receipt expires. Reverification should be done not later than the date of expiration of the work authorization. The worker may lose their job if the employer does not reverify the authorization. Temporary workers with work visas are advised to file for an extension no later than 90 days prior to the expiration date of their EAD. Certain categories of employment eligibility that are able to submit on time EAD renewal applications can be granted automatic extensions for their expiring EADs.
Employers can fill out the Section 3 of the original Form I-9, if the original version is latest version of the form. If the original Form I-9 is older, the employer should fill out Section 3 or complete a completely new I-9 with the current version. In either situation the employer should attach the new Form I-9 to the original one.
The employee who signed the receipt for a document when completing the I-9 initial form is given 90 days to present his employer with the replacement document. Employers are required to use Section 3 of the current Form I-9 in order to change the information or draw an outline around the information that was previously provided to ensure it is legible. Once the line is drawn, the employer must insert the updated information and then confirm the change by inking it. If the employee is able to present another acceptable document within the time limit and the employer is required to complete Section 2 on the new Form I-9. Attach it to the original Form I-9.
I-9 forms that list green cards that are now expired must not be updated. Green cards are a permanent residence permit that is able to be used within the United States. They expire similar to driver’s licenses. The expiration date doesn’t suggest that the person who holds the card has been unable to work in the U.S.
Employers may also amend Section 3 of Form I-9 in the event that an employee’s name is changed. But, it’s not required to do so.
