Are Employers Legally Required To Update Or Revise I-9 Documents?
Print I 9 Forms 2022 – Employers must revise an employee’s paperwork only when the employee’s employment authorization documentation (EAD) or receipt is expired. Reverification must be done no later than the expiration date of the authorization to work. Employees could be fired if the employer fails to update the authorization. Temporary visa holders are advised to request an extension no later than 90 days before the expiration of their EAD. Certain categories of employment that are able to submit on time EAD renewal applications can be granted automatic extensions for their expiring EADs.
Employers may fill out the Section 3 of the Form I-9 originally used only if it’s the current version of the form. If the original Form I-9 is older, the employer has to fill out Section 3 or complete a completely new I-9 for the most current version. Employers must join the updated Form I-9 with the original.
If an employee gave the document in a receipt when completing the initial form I-9 in the first place, he/she has 90 days to give employers the new document. When that happens, the employer should utilize Section 3 on the current version of the Form I-9 to modify the information or draw a line over the information from the prior version (so that it remains usable) to insert the updated information, and then mark the change. If the employee can provide another acceptable document within the stipulated time then the employer should complete Section 2 of the new Form I-9. Attach it to the original Form I-9.
I-9 forms that contain green cards that have since expired must not be updated. Green cards are permanent residence permit that is able to be used within the United States. They expire just like driver’s licenses. The date of expiration doesn’t mean that the holder is no longer authorized to work in the U.S.
Employers may also amend Section 3 of the Form I-9 if the employee’s name is changed. But, it’s not required to do this.
