When Are Employers Required To Revise Or Update I-9 Documents?
Printable I-9 Form 2022 – Employers should reverify documentation for employees at the time that an employee’s employment authorization (EAD) or receipt is due to expire. Reverification should be done at least one year prior to the date of expiration of the work authorization. If the employer is unable to update the work authorization, then the worker’s job may not be extended. Temporary workers with work visas are advised to file for an extension no later than 90 days prior to the expiration of their EAD. Certain categories of employment eligibility may be eligible for automatic extensions of expired EADs in the event that they file in time EAD renewal applications.
Employers may fill out Section 3 of the Form I-9 originally used, if the original version is current version of the form. If the original version is an earlier version of Form I-9 employers must either fill out Section 3 on the current version of the I-9 or fill out a fresh I-9 entirely on the current version. Employers must be sure to attach the latest Form I-9 with the original.
If an employee gave the document in a receipt upon initially completing the I-9 in the first place, he/she has 90 days to give employers the new document. When that happens, the employer should use Section 3 on the current version of the Form I-9 to update the information or draw a line across the information from the prior version (so that it’s legible) and then insert the new information, and then acknowledge the update. If, during the 90-day window, the employee wants to present a different acceptable document that is different from the document the receipt was issued to then the employer must complete Section 2 of a new Form I-9 and attach it to the original Form I-9 and provide a note of explanation in the box for additional information that is located on page 2 of the Form I-9 or as a separate attachment.
I-9 forms with green cards that have expired since then , they should not be issued again. Green cards indicate permanent residency within the United States, and they expire as driver’s licences do. The date of expiration does not indicate that the holder has been unable to work in the U.S.
Employers are also able to update Section 3 of the Form I-9 if the employee’s name changes. But, it’s not required.
