USCIS Form I-9 2022 – Form I-9, also referred to as the Employment Eligibility Verification is a United States Citizenship and Immigration Services document. Mandated by the Immigration Reform and Control Act in 1986, it’s used to verify the identity and legal authority to work of all employees paid in the United States. When Do Employers Have To Update Or Revise Their I-9 Documents?
USCIS Form I-9 2022 – Employers should reverify documentation for employees after the employee’s employment authorization (EAD) or receipt expires. Reverification should take place not later than the expiration date of the work authorization. If the employer fails to amend the work authorization, then the worker’s job may end. Temporary work visa holders are advised to file for an extension at least 90 days prior to the expiration date of their EAD. Some employment eligibility categories may be eligible for automatic extensions for their expired EADs by submitting in time EAD renewal applications.
Employers may fill out the Section 3 of the Form I-9 originally used provided that the original is the latest version of the form. If the original Form I-9 is older, the employer has to complete Section 3 or complete a completely new I-9 for the most current version. The employer should attach the updated Form I-9 to the original.
A worker who provided the receipt for any document while filling out the I-9 initial form is given 90 days to present his employer with the replacement document. The employer must use Section 3 on the current version of the form to correct the information or draw a line through the old information (so that it’s usable) and then add the new information, then sign and mark the new information. If, within the 90-day timeframe, the employee wants to present a different acceptable document, which differs from the document the receipt was issued to The employer should fill out Section 2 on a new Form I-9 and attach it to the original Form I-9 and provide a note of clarification either in the additional information box found on page 2 of the Form I-9 or as a separate attachment.
I-9 forms that mention green cards that are now expired, should not be renewed. The green card is a permanent residence permit, which can be used in the United States. They expire similar to driver’s licenses. However, the date of expiration is not a sign that the holder has lost their authorization to work in the US.
Employers can also update Section 3 of the Form I-9 if an employee’s name changes. However, it is not required to do it.
