What Is The Deadline For Employers To Reverify Or Update I-9 Documents?
USCIS I-9 2022 – Employers should reverify documentation for employees at the time that an employees’ employment authorization (EAD) or receipt is due to expire. The reverification process must be completed prior to the expiration date of the work authorization. The worker could be fired if the employer fails to update the authorization. Temporary workers with work visas are advised to file for an extension not later than 90 days before expiration of their EAD. Some employment eligibility categories may be entitled to automatic extensions for their expired EADs by submitting in time EAD renewal requests.
If the form originally used is current employers can fill in the Section 3 of the original I-9. If the original form is an earlier version of the Form I-9 then the employer must either complete Section 3 on the current version of the I-9 or fill out a fresh I-9 entirely with the current version. The employer must join the updated Form I-9 to the original.
If an employee provided an acknowledgment of a document when completing the initial form I-9 and was not able to provide a receipt, the employee has 90 days to give the employer the updated document. When that happens, the employer should utilize Section 3 on the current version of the I-9 form to change the information or draw a line over the previous information (so that it remains legible) and then insert the new information, and then sign and mark the modification. If the employee presents another acceptable document within the time limit and the employer is required to complete Section 2 of the new Form I-9. Attach it to the original Form I-9.
I-9 forms that contain green cards that have expired and the time they expire, they shouldn’t be issued. Green cards guarantee permanent residency in the United States, and they expire the same way as driver’s licenses do. The expiration date does not mean that the holder is no longer authorized to work in the U.S.
Employers are also able to update Section 3 of Form I-9 if the employee’s name changes. However, it’s not required.
