What Is The Time Frame For Employers To Revise And Revise I-9 Documents
What Is A I9 Form 2022 – Employers must reverify employee documentation at the time that an employee’s employment authorization (EAD) or receipt is due to expire. Reverification should be done at least one year prior to the date of expiration of the authorization. If the employer isn’t able to reverify the work authorization, the worker’s job may not continue. Temporary work visa holders are advised to request an extension at least 90 days before the expiration date of their EAD. Certain employment eligibility categories could be eligible for automatic extensions of expired EADs when they submit in time EAD renewal applications.
If the form originally used is in use employers can fill in the Section 3 of the original I-9. If the original Form I-9 is older, the employer should fill in Section 3 or complete a completely new I-9 for the most current version. In either of these scenarios the employer should attach the new Form I-9 to the old one.
If an employee issued an acknowledgment of a document at the time of completing the I-9 and was not able to provide a receipt, the employee has 90 days to show the employer the updated document. At that time, the employer should make use of Section 3 on the current version of the Form I-9 to update the information, or draw a line along the old information (so that it’s usable), insert the new information, and then sign and mark the new information. If, within the 90-day timeframe, the employee decides to submit another acceptable document that is different from the document the receipt was issued for and the employer is required to complete Section 2 on the new Form I-9 and attach it to the original Form I-9 and provide a note of explanation in the box for additional information that is located on page 2 of the Form I-9 or as a separate attachment.
I-9 forms that have green cards that have expired since the time they expire, they shouldn’t be issued. Green cards guarantee permanent residency in the United States, and they expire as driver’s licences do. The expiration date doesn’t suggest that the person who holds the card has been unable to work within the U.S.
Employers are also able to modify the Form I-9 in Section 3 whenever an employee is affected by changed their name, however there is no requirement to do so.
