When Do Employers Have To Update Or Revise I-9 Documents?

What Is An I9 2022 – Employers must revise an employee’s paperwork only when the employee’s employment authorization certificate (EAD) or the receipt is expired. Reverification should occur no later than the actual expiration date of the work authorization. If the employer is unable to update the work authorization, then the worker’s contract may not continue. Employees who are on temporary work visas are urged to apply for extension requests at least 90 days before the date they expire on their EAD. The employee who signed the receipt for a document when completing the I-9 initial form is given 90 days to present their employer with the replacement document. Employers are required to use Section 3 of the current Form I-9 to alter the details or draw an outline over the old information so that it is legible. Once the line is drawn, it is time to insert the new information and confirm the change by inking it. If an employee submits another acceptable document within the stipulated time that the employer has to fill out Section 2 of the current Form I-9. Attach it to the original Form I-9.

I-9 forms that contain green cards that have since expired, should not be renewed. Green cards guarantee permanent residency in the United States, and they expire as driver’s licences do. The expiration date does not necessarily mean that the owner is no longer authorized to work in the U.S.

Employers may also choose to update the Form I-9 in Section 3 in the event of a name change, but there isn’t a requirement to do this.
