When Do Employers Have To Revise Or Update I-9 Documents?
What Is An I9 Form 2022 For Employment – Employers are required to reverify the documentation of employees only when the employee’s employment authorization document (EAD) or receipt is expired. Reverification should occur before the date of expiration for the work authorization. If the employer isn’t able to reverify the work authorization, the worker’s job may not continue. Temporary visa holders are advised to request an extension no later than 90 days before expiration date of their EAD. Certain categories of employment eligibility may be qualified for automatic extensions for their expired EADs by submitting on time EAD renewal requests.
Employers may complete Section 3 of the Form I-9 originally used if it’s the current version of the form. If the original form is an earlier version of the Form I-9 employers must either fill in Section 3 on the current version of the I-9 or fill out a new I-9 completely with the current version. The employer should attach the updated Form I-9 with the original.
If an employee provided the document in a receipt after completing the I-9 in the first place, he/she is given 90 days to provide the employer the updated document. Employers are required to use Section 3 of the current Form I-9 to alter the details or draw an outline through the previous information to ensure it can be read. Once the line is drawn, the employer must insert the new information and sign and ink the change. If an employee submits an acceptable document within the stipulated time, the employer must complete Section 2 on the latest Form I-9. Attach it to the original Form I-9.
I-9 forms that include green cards that have expired and they were issued, should not be renewed. The green card is a permanent residence permit that is able to be used in the United States. They expire like driver’s licenses. However, the date of expiration doesn’t mean that the holder has lost their authorization to work in the United States.
Employers can also update Section 3 of the Form I-9 if an employee’s name changes. However, it’s not required to do so.
